Terms of Agreement:

1.Definition of Terms
•  “ReStoring Data Inc.” means the company holding this title or any person authorized to act on its' behalf.
•  “Client” means anyone seeking ReStoring Data Inc.'s services by signing this work order.

2.Authorization:
•  The client authorizes ReStoring Data Inc. to perform a free evaluation of the media being submitted for data recovery purposes. ReStoring Data Inc. will provide the customer with a firm quote of the recovery cost and an estimate of turnaround time. No work, beyond the evaluation, will be done without the written approval of the client.
•  The client authorizes ReStoring Data Inc. to receive and transport the client's media/equipment/data between various facilities in order to perform a free evaluation and data recovery service, recognizing that ReStoring Data Inc is not liable for loss or damage of packages during shipping.

3.Legal Rights:
•  The client is the legal owner, representative, or otherwise holds uncompromised ownership rights to the items and all data contained therein submitted to ReStoring Data Inc.

4. Manufacturer's Warranty:
•  The client agrees that during the process of data recovery, and evaluation, it may be necessary to break the seals of the media, in a few cases making the manufacturer's warranty void.

5.Limited Liability:
•  ReStoring Data, Inc. is not responsible for damage caused to the media during the recovery procedures, or evaluation.
•  If the media device is found to been tampered with or has broken seals, indicating previous recovery efforts, ReStoring Data Inc. is entitled to charge a 50% fee on top of the regular quote reflecting the increase in complexity of the recovery, as part of our 2 nd Attempt Data Recovery Service.
•  ReStoring Data, Inc. will not be liable for any claims regarding the functioning of equipment/media or the condition and existence of data on storage media supplied before, during or after service.
•  The client understands that data recovery is not guaranteed. ReStoring Data, Inc. is not liable for any direct or indirect damages, including loss of data, loss of revenue, incidental or consequential effects, before, during or after service.
•  Any property left with ReStoring Data Inc., unclaimed for 30 days, will be destroyed and recycled, at which time ReStoring Data Inc. will have no liability to the client or any third party.

6. Confidentiality:
•  ReStoring Data, Inc. agrees to absolute non-disclosure of any and all information or data files supplied with, stored on, or recovered from a client's case, as per the Freedom of Information and Protection of Privacy Act [RSBC 1996] Chapter 165.

7. Payment:
•  A list of all recovered files will be sent to a customer for approval of the completion of work. Once approved, payment will be due in full, prior to release of data.
•  Once the quote is approved, there will be a $100 cancellation fee for withdrawal or full quote amount if the recovery has been completed.
•  All payments are subject to applicable taxes.
•  2 nd Attempt Data Recovery Service requires a $50 charge, which will be applied towards service fees if recovery is successful.

8. Media Warranty:
•  ReStoring Data, Inc. gives warranty on all return media found to be Dead on Arrival (DOA) within 14 days of shipment. Any additional warranty claims must be presented to the original manufacturer.
